Personal data we process

Employ IR B.V. processes your personal data because you use our services and because you provide that data to us yourself. Which data this is depends on your relationship with us.

If you apply or register with us

  • First name and surname, gender and date of birth
  • Address, telephone number and email address
  • Nationality and place of birth
  • Curriculum vitae, work experience and education
  • Diplomas, certificates and proof of professional competence
  • Covering letter and notes from interviews
  • References, insofar as you provide them yourself
  • Availability and work preferences

If you start working through us

  • Citizen Service Number (BSN)
  • A copy of your identity document
  • Bank account number
  • Details of your employment contract, hours worked and pay
  • Details of leave and absence, without medical information

If you are moving to the Netherlands from abroad

  • Data needed for your residence and work permit
  • Data about housing and your arrival in the Netherlands
  • Data about family members moving with you, insofar as the application requires it

If you are a contact person at a client

  • Name, job title, business telephone number and business email address

If you visit our website

  • Data about your visit, and cookies or similar techniques. What exactly we place and why is set out in our cookie statement. That overview updates itself whenever the services we use change, so it is always current.

Special categories of personal data and the BSN

Your Citizen Service Number and a copy of your identity document are not special categories of personal data under the GDPR, but they are subject to a strict regime. We process them only because the law requires us to: the identification obligation under the Dutch Wage Tax Act and the Foreign Nationals Employment Act. We never use them for any other purpose.

We do not process special categories of personal data such as health, origin or religion. If someone reports sick, we only record that there is absence and not the reason for it.

What we use your data for

Every processing activity needs a legal basis. The table below sets out which basis applies to which purpose.

You can withdraw consent at any time. That takes effect from that moment and does not affect processing that already took place.

How long we keep your data

We do not keep your data for longer than is necessary for the purpose we received it for. We apply the following periods.

Who we share your data with

We do not sell your data. We share it only where that is necessary for our services or where the law requires it. This concerns the following parties:

  • Clients we introduce you to. We share your profile and your experience, and only once you have agreed.
  • Our payroll and HR administration, for paying your salary and remitting taxes.
  • The Immigration and Naturalisation Service and the UWV, for residence or work permit applications.
  • The Tax Administration and other competent authorities, where the law requires it.
  • Our IT suppliers, who process data on our behalf. These include RecruitNow (our candidate system and the application forms), Vercel (hosting of this website) and Resend (sending email from the website).

With parties that process data on our behalf we enter into a data processing agreement, so that your data is protected there as well as it is with us. Employ IR B.V. remains responsible.

Transfers outside the European Economic Area

Employ IR recruits technical professionals in South Africa and has colleagues working there. As a result, your data is also processed outside the European Economic Area.

South Africa does not have an adequacy decision from the European Commission. We therefore base that transfer on the European Commission’s standard contractual clauses, and we share no more data than the placement requires. If you would like to know what has been agreed, you can request it from us.

Automated decision-making

Employ IR B.V. does not take decisions about you on the basis of automated processing. A person always assesses whether you are a fit for a vacancy.

Accessing, correcting or deleting your data

You have the right to access, correct or delete your personal data. You also have the right to withdraw your consent, to object to processing, and the right to data portability. That means you can ask us to send your data in a computer file to you or to another organisation.

Send your request to E.nijeboer@employ.nl. We will respond as soon as possible, and in any case within four weeks.

To make sure the request comes from you, we ask you to enclose a copy of your identity document. In that copy, black out your passport photo, the MRZ (the strip of numbers at the bottom of the passport), your passport number and your BSN. This is to protect your own privacy.

Making a complaint

If you disagree with how we handle your data, we would like to hear it from you first. If we cannot resolve it together, you can lodge a complaint with the Dutch Data Protection Authority at autoriteitpersoonsgegevens.nl.

How we secure your data

Employ IR B.V. takes the protection of your data seriously and applies appropriate measures against misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification. This includes encrypted connections, access limited to colleagues who need the data, and agreements with our suppliers.
